Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and These Conversations Matter, operated by Susanne Thomas (“we,” “us”). By accessing or using the website and the MI - am I? Practice Studio (together, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. Educational purpose — not therapy or medical advice

The Service is an educational practice environment for learning Motivational Interviewing (MI) skills. It is provided for training and self-development purposes only. The Service is not therapy, counseling, medical advice, mental-health treatment, crisis intervention, or a substitute for care from a licensed professional. If you are experiencing a crisis, contact your local emergency services or a qualified provider immediately.

2. AI-generated content

Practice Studio uses large language models (currently provided by Anthropic) to generate simulated client responses. AI output can be inaccurate, incomplete, biased, or otherwise unsuitable. You are responsible for evaluating any AI-generated content and must not rely on it for clinical, legal, financial, or other professional decisions.

3. Accounts

Some features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use. You are responsible for activity under your account.

4. Acceptable use

  • Do not submit unlawful, infringing, harassing, or harmful content.
  • Do not attempt to bypass security, rate limits, or access controls.
  • Do not use the Service to provide clinical care, diagnose, or treat anyone.
  • Do not upload other people’s personal information without authorization.
  • Do not reverse engineer, scrape at scale, or use the Service to train competing models.
  • Do not impersonate others or misrepresent your affiliation.

5. Paid services and refunds

Some features (including MITI coding) are paid. Prices and payment methods are shown at the point of purchase. Payments are currently processed by PayPal or Zelle, and you agree to the terms of the relevant processor. Unless required by law or expressly stated otherwise, fees are non-refundable once review work has started or notes have been delivered. If payment is made but no transcript is sent, a refund may be requested after 7 days. Refund requests: susanne.thomas.mi@gmail.com.

6. Intellectual property

The Service, including its design, text, graphics, scenarios, code, and trademarks, is owned by us or our licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain rights in the content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content as needed to operate, secure, and improve the Service.

7. Third-party services

The Service relies on third parties (e.g., Anthropic, Supabase, Vercel, PayPal, Zelle, PostHog, Resend, Upstash, Sanity). We are not responsible for their availability, content, or practices, and your use of those services is governed by their own terms.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected violation of these Terms. You may stop using the Service at any time. The provisions that by their nature should survive termination will survive.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there. Where mandatory consumer protection laws of your country of residence apply, nothing in these Terms limits those rights.

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after an update constitutes acceptance.
